Five-member larger bench of Supreme Court led by Justice Asif Saeed Khosa resumed the hearing of Panama Leaks Case today. In today’s hearing PM’s counsel Makhdoom Ali Khan continued with his arguments before the bench whereas Prime Minister Nawaz Sharif has sought indirect immunity under Article-248. Meanwhile, PM Nawaz Sharif’s daughter Maryam Nawaz has also submitted her reply in the court today and assured that she was never dependant to her father Nawaz Sharif after her marriage.
Makhdoom Ali Khan said that they are asking for a constitutional immunity under Article-248 besides Article-66. He explained while making arguments that Article-248 grants immunity to the prime minister’s office, not to PM as an individual. He supported his arguments through Chaudhary Zahoor Elahi’s case by saying that former Prime Minister and founder of Pakistan People’s Party’s (PPP) Zulfiqar Ali Bhutto also sought immunity in a case.
Justice Khosa said that in Chaudhary Zahoor Elahi’s case, the Prime Minister never delivered a speech in the National Assembly. PM’s counsel continued that Article-19 allows everyone to exercise his or her right of freedom of speech. To this, Justice Khosa told Makhdoom Ali Khan said and told PM’s counsel that Article-19 gives you freedom of speech, but here he is not seeking that right, he is seeking the immunity. The hearing of the case will resume tomorrow.
